Thank you for choosing Niche Escapes. By using the Niche Escapes website, mobile applications, and other services (collectively, the “Platform”), you agree to comply with and be legally bound by the following terms and conditions (the “Terms”). These Terms govern your access to and use of the Platform and constitute a binding legal agreement between you and Niche Escapes, Inc. (“Niche Escapes,” “we,” “us,” or “our”).
Please read these Terms carefully before using the Platform. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Platform.
Guest Terms
1. Searching and Booking on Niche Escapes
1.1 Searching: On Niche Escapes, you can look for Host Services by specifying criteria like service type, listing type, destination, travel dates, and guest numbers. Filters help narrow down search outcomes. Results are ordered based on relevance, factoring in aspects like price, availability, reviews, customer service history, popularity, your past trips and saved Listings, Host requirements (such as minimum stay duration), and others. For a deeper understanding of how search results are determined, refer to Section 5.3 and our Help Center.
1.2 Booking: By booking a Listing, you commit to the Total Price, which includes the Listing price, service fees (both Niche Escapes’s and any offline fees), taxes, and any other costs mentioned at checkout. If your payment currency differs from the Host’s listing currency, we convert the price using a rate we determine. Booking confirmation establishes a Reservation contract directly with the Host, governed by these Terms plus any additional Reservation conditions, including cancellation policies and other rules or requirements mentioned in the Listing or during checkout. It’s crucial to review these additional terms before finalizing your booking. Note that some Hosts may collaborate with co-hosts or teams to provide their services.
1.3 Accommodation Reservations: An Accommodation Reservation grants you a limited right to enter, occupy, and use the accommodation. The Host retains access rights under reasonable necessity, as allowed by your agreement and applicable law. Overstaying beyond checkout can result in legal eviction and penalties. Guest numbers must not surpass the allowed limit.
1.4 Reservations for Experiences and Other Host Services: Booking an Experience or other Host Service entitles you (and any invited guests) to partake or attend, provided you meet any required age, skill, fitness, or other prerequisites. You’re obliged to inform the Host of any health or physical conditions that might affect your participation. Except as explicitly allowed, you cannot bring additional persons to an Experience or Service not listed as additional guests during booking.
2. Cancellations, Reservation Issues, Refunds, and Booking Modifications
2.1 Cancellations, Reservation Issues, and Refunds: Cancellation refunds are primarily determined by the applicable cancellation policy. However, special circumstances or policies might dictate different refund amounts. Our Extenuating Circumstances Policy may offer partial or full refunds for cancellations due to unforeseeable events. Host cancellations or Reservation Issues, as defined in our Rebooking and Refund Policy, could qualify you for rebooking assistance or refunds. Specific policies apply to certain Listing types, such as Experiences governed by the Experiences Guest Refund Policy. Refer to each policy for coverage and refund details. Appeals against Niche Escapes decisions can be made to customer service.
2.2 Booking Modifications: Both Hosts and Guests are responsible for any Booking Modifications agreed upon through the Niche Escapes Platform or arranged by Niche Escapes customer service, including any associated additional charges, fees, or taxes.
3. Your Responsibilities
As a user of Niche Escapes, you bear full responsibility for your actions and their consequences, as well as those of anyone you allow to participate in or access the Accommodation, its Common Areas, or any Experience or Host Service you book. Specifically, this means:
- Property and Common Areas: You are obliged to maintain the condition of the Accommodation and any related personal property, as well as Common Areas you have access to, just as you found them upon arrival.
- Damage Claims: You are accountable for covering all costs associated with reasonable Damage Claims made by Hosts for any damage you or your invitees cause during your stay.
- Conduct: You must conduct yourself with honesty and respect towards others at all times, adhering to all relevant laws. This encompasses respecting the Host’s property, neighborhood, and community standards.
- Minors: If your booking includes minors or if you bring minors to a Host Service, you must have the legal authority to act on their behalf. Furthermore, you are solely responsible for their supervision, ensuring their safety, and making sure their behavior aligns with the terms and conditions of the service.
Your responsibilities extend beyond just your behaviour; they include ensuring that those you invite or bring along adhere to these standards and obligations. Failure to do so could result in penalties, additional charges, or suspension from the Niche Escapes platform.
